Legal Notice and Participant Agreement

Welcome to WV Adventure Rides! To ensure a safe, enjoyable, and legally compliant experience for all participants, please carefully read the following terms and conditions. By participating in our activities, you agree to abide by these rules and accept the responsibilities outlined below.

1. Acceptance of Risks

Participation in adventure and outdoor recreational activities comes with inherent risks. These include, but are not limited to:

• Physical Risks: Personal injury, dehydration, fatigue, or exposure to natural hazards such as wildlife, uneven terrain, and extreme weather conditions.

• Equipment Risks: Malfunction, improper use, or failure of gear and machinery, including but not limited to ATVs, mountain bikes, ziplining equipment, or kayaks.

• Environmental Risks: Rocks, loose soil, rivers, cliffs, and other unpredictable natural conditions.

By engaging in activities offered by WV Adventure Rides, participants voluntarily assume these risks and agree not to hold WV Adventure Rides liable for injuries, damages, or losses, except in cases of gross negligence or misconduct.

2. Participant Responsibilities

To ensure the safety of all involved, participants must agree to the following:

1. Follow Instructions: Adhere to all guidelines, safety procedures, and instructions provided by WV Adventure Rides staff at all times.

2. Use Equipment Properly: Utilize all safety gear, including helmets, harnesses, and protective clothing, as directed.

3. Health and Fitness: Certify that you are in good physical and mental health to participate in activities. Notify staff of any medical conditions, such as heart issues, allergies, or recent surgeries, before participation.

4. Substance Use: Abstain from consuming alcohol, recreational drugs, or any substances that impair judgment or physical ability before or during participation.

5. Age Restrictions: Ensure all participants meet the minimum age and height requirements for specific activities.

6. Parental Responsibility: Parents or guardians accompanying minors are responsible for supervising them and ensuring they adhere to all rules.

Failure to comply with these responsibilities may result in immediate dismissal from activities, with no refund provided.

3. Company Responsibilities

WV Adventure Rides is committed to providing a safe and enjoyable experience. As such, we will:

• Maintain all equipment to meet safety standards through regular inspections.

• Provide trained, certified, and knowledgeable staff for guided activities.

• Offer safety briefings before all activities and ensure emergency protocols are in place.

• Monitor weather conditions to avoid unnecessary risks.

4. Liability Waiver

By participating in WV Adventure Rides activities, participants agree to the following waiver:

“I, the undersigned, fully understand and acknowledge that my participation in activities involves risks, dangers, and hazards. I voluntarily assume all risks and release WV Adventure Rides, its employees, contractors, and affiliates from liability for injuries, damages, or losses incurred during participation, except where caused by gross negligence or misconduct.”

5. Cancellation and Refund Policy

• Participant Cancellations: A refund or rescheduling is available for cancellations made at least 48 hours before the scheduled activity. No refunds will be issued for late cancellations or no-shows.

• Company Cancellations: WV Adventure Rides reserves the right to cancel or reschedule activities due to weather, safety concerns, or other unforeseen circumstances. Participants will receive a full refund or the option to reschedule in such cases.

6. Compliance with West Virginia Laws

WV Adventure Rides operates in compliance with all state and local laws, including but not limited to:

• Zipline and Canopy Tour Responsibility Act (§21-15): Ensuring annual registration, inspections, and permits for all zipline and canopy tours.

• Adventure and Recreational Responsibility Act (§20-16): Upholding safety standards and ensuring all participants are aware of their responsibilities.

• Helmet Laws and ATV Regulations: Requiring helmets and adherence to West Virginia ATV laws, including restrictions on unlicensed drivers.

7. Assumption of Responsibility

Participants acknowledge they are solely responsible for:

• Wearing appropriate clothing and footwear.

• Protecting personal belongings from damage, theft, or loss.

• Being aware of their own limitations and not engaging in activities beyond their skill level.

8. Governing Law and Dispute Resolution

This agreement is governed by the laws of the State of West Virginia. In the event of a dispute, participants agree to resolve matters through mediation or arbitration in West Virginia courts.

9. Media Release

By participating, you consent to WV Adventure Rides using any photographs, videos, or recordings taken during activities for promotional or marketing purposes. If you do not wish to be included, please notify staff in writing before your scheduled activity.

10. Privacy Policy

WV Adventure Rides respects your privacy and will not share personal information without consent, except as required by law. Payment information is handled securely and in compliance with industry standards.
